Asylum and Other Immigration Affidavits

Asylum Affidavits

Asylum applicants have a lot on the line – oftentimes, their very lives depend on a favorable outcome for their case. A well-crafted affidavit can go a long way toward detailing the persecution your client has suffered and the reasons behind it.

Survivors of persecution (and those who otherwise have credible fear of persecution) have often endured a significant amount of trauma. In order to produce a comprehensive and compelling affidavit, it is crucial to understand the elements that must be proven in an asylum case and ask the applicant pertinent questions, probing for details while still being sensitive to the emotional, mental and physical trauma that they may have already suffered.

The asylum affidavit drafting process includes the following:

  • Review evidence of any persecution presented, if any (police reports, medical reports, court records, photographs, written threats, client’s statement, etc.)
  • Interview applicant via phone or Skype*
  • Draft affidavit for attorney’s review
  • Unlimited revisions to affidavit at attorney’s request

Other Immigration Affidavits, Declarations, and Sworn Statements

(Waivers of Grounds of Inadmissibility, Cancellation of Removal, DACA, etc.)

There are many reasons why your client may need to seek discretionary immigration relief- and just as many reasons why an attorney may want to ensure that they have a well-written affidavit, declaration, or sworn statement to submit in support of their petition or application. It is important that the facts be presented clearly while straightforwardly addressing the criteria for the case.
